Legal Helpers Tip: Florida has three federal districts: northern, middle, and southern district. Your Florida bankruptcy lawyers have access to the Case Management/Electronic Case Files (CM/ECF) system that is now so popular with attorneys. They can monitor your case progress 24 hours a day, if necessary. All filings are at their fingertips electronically through the Internet regardless of where your lawyer is at any given time. They will also advise you that Florida has excellent exemption laws, including an unlimited homestead exemption. However, you must be aware of one bankruptcy law that sometimes poses a problem in Florida. To file in Florida, you must have been a resident for 730 consecutive days, two years, or you’ll have to file in wherever you spent the majority of the 180 days prior to your current residence. Since many Florida residents often spend living time in other states, be prepared to verify your residency.
